Terms & Conditions
These Terms & Conditions apply to bookings made with 5DAY®. The version of the Terms & Conditions in force at the time of your booking confirmation will apply to your course.
1. Eligibility
1.1 Age Requirements
Attendees must be at least 17 years old, or 16 years old if eligible for the full mobility component of the Personal Independence Payment (PIP).
1.2 Licence Requirements
You must hold a valid UK or Northern Ireland provisional or full driving licence.
Proof of licence must be provided prior to the start of your course. Failure to provide valid proof of licence may result in course cancellation, and 5DAY® may deduct reasonable costs already incurred or committed, including instructor time and administration.
2. Course Bookings, Cancellations & Cooling-Off Rights
2.1 Booking Confirmation
Your course is confirmed once full payment is received and acknowledged in writing by 5DAY®, or where payment is made through an approved third-party payment provider, once the payment provider confirms the payment or approved payment arrangement to 5DAY®.
By completing your booking, submitting payment and accepting these Terms & Conditions, you agree to be bound by them.
Where a third-party payment provider or finance option is used, approval is subject to that provider’s own checks, terms and eligibility criteria. 5DAY® is not responsible for any decision made by a third-party payment provider.
2.2 Cooling-Off Period
In accordance with the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013, you have the right to cancel your course within 14 days of booking.
Cancellation requests should be made in writing, preferably by email to:
Telephone cancellation requests should be confirmed in writing so that 5DAY® has a clear record of the cancellation request and the date it was made.
If you ask 5DAY® to begin providing, arranging or committing services during the 14-day cancellation period, deductions may be made for services already supplied and reasonable non-recoverable costs already incurred or committed, as set out in these Terms & Conditions.
Where the course has been fully provided within the 14-day cancellation period at your express request, and you acknowledged that cancellation rights may be affected once the service has been fully provided, your right to cancel may be lost to the extent permitted by law.
After the 14-day cooling-off period, cancellations and refunds are no longer available except as outlined in these Terms & Conditions or where required by law.
2.3 Short-Notice Bookings and Early Course Preparation
Where a course is booked within 14 days of the course start date, you expressly request 5DAY® to begin course preparation immediately. This may include administration, instructor allocation, theory-test arrangements, course coordination, communication with instructors, and other arrangements required to deliver the course.
You still retain any statutory cancellation rights that apply. However, if you cancel after 5DAY® has begun providing, arranging or committing services at your request, 5DAY® may deduct reasonable costs for services already supplied and non-recoverable costs already committed, including instructor allocation and administration.
Where the course has already commenced or has been fully provided, refunds will be assessed in accordance with these Terms & Conditions and your statutory rights.
2.4 Cancellations or Changes After Cooling-Off Period
You may cancel or reschedule your course after the cooling-off period only by providing a minimum of 20 days’ written notice.
Courses may be rescheduled up to three times within a three-year period, subject to availability. Once a course has been rescheduled, you may not be entitled to a full refund, particularly where 5DAY® has already incurred or committed costs.
Prices are subject to inflationary increases, and any difference in course price may be payable when a course is rescheduled.
Cancellations within 20 days of the course start date are non-refundable to the extent that 5DAY® has incurred or committed non-recoverable costs, including instructor fees of up to £1045.
Exceptional circumstances, such as serious illness, may be considered at management discretion, but refunds are not guaranteed unless required by law.
3. Course Format and Attendance
3.1 Course Duration
Courses run over five consecutive training days, either in person or online, depending on location and course type.
5DAY® reserves the right to adjust course format, times or content due to unforeseen circumstances, operational requirements, instructor availability, DVSA-related issues, or events outside 5DAY®’s reasonable control.
3.2 Course Timetables
Refer to your course confirmation email for your specific timetable.
Typical course times are:
- “A” Course: 10:00–14:30
- North London and Ipswich “A” Course: 09:00–13:30
- “B” Course: 14:30–19:00
- Online theory training: 16:30–18:30, although times may vary
- “B” Course online theory training: 10:00–12:00
3.3 Attendance Requirements
You must attend punctually each day.
No additional time, replacement time or refund will be provided for lateness, absence or early departure by the pupil.
Our courses are intensive and fast-paced by design. They may not be suitable for all individuals, particularly those who may experience difficulty with sustained focus, high-pressure learning environments, or accelerated instructional formats.
Prospective participants should carefully consider their ability to meet these demands before enrolling.
4. Training and Instructor Standards
Driving tuition is provided by DVSA-approved driving instructors under national training standards.
5DAY® aims to prepare pupils for their practical test within five days, but test-readiness is not guaranteed and varies by individual. Whether a pupil is test-ready depends on ability, progress, safety, confidence, consistency, road awareness and the professional judgment of the instructor.
Any additional tuition beyond the scope of the original 5DAY® course must be arranged directly between the learner and the instructor.
5DAY® accepts no responsibility or liability for private arrangements made directly between the learner and instructor, including payment, scheduling, cancellation, availability or instructional outcomes.
5. Theory Test
5DAY® will book your first DVSA theory test at the current government rate, where applicable.
You must bring your UK provisional photo licence to the theory test.
Failure to bring the required licence or documentation may result in the test being refused by the DVSA. 5DAY® is not responsible for any DVSA refusal caused by the pupil failing to bring the required documentation.
6. Free Theory Retraining
If you fail your theory test, you are eligible for unlimited free theory retraining sessions, online or in person where available, during scheduled training hours.
Free theory retraining is subject to course availability, scheduled session times and reasonable engagement by the pupil.
7. Practical Driving Test, Car Hire & Limitations
7.1 First Driving Test
Due to DVSA policy changes, from 12 May 2026, only the learner driver is permitted to book, change, cancel or manage their own car practical driving test. Third-party companies, driving instructors and driving test cancellation apps are no longer permitted to book or manage car driving tests for learners.
Responsibility for securing a practical driving test slot sits with the pupil.
5DAY® does not include the booking or supply of a DVSA practical driving test slot as part of the 5DAY® course.
5DAY® may provide guidance, support and administration where lawful and practical, but the pupil remains responsible for booking, managing and complying with all DVSA practical test booking requirements.
Conditions of Service Redemption and Expiry
Any request to redeem, arrange, continue, reschedule or rely upon any remaining 5DAY® service entitlement must be submitted in writing within 24 months of the original course commencement date.
The Customer is required to maintain active participation throughout this period, including attendance where required, reasonable communication with 5DAY®, and engagement with any agreed training, mentoring, test-related or administrative process.
After 24 months from the original course commencement date, all remaining non-statutory service entitlements shall automatically expire. 5DAY® shall have no further obligation to provide, arrange, honour, extend, reschedule, refund or otherwise continue any part of the course, mentoring, retraining, vehicle use, test support, administrative support or any other related service, except where required by law.
This expiry period reflects, among other factors, the limited validity of DVSA theory test pass certificates, which must be used within two years of passing the theory test. Where a theory test pass certificate has expired, the Customer is responsible for retaking and passing the theory test again.
Nothing in this clause affects the Customer’s statutory rights.
Test Conditions
5DAY® does not include a practical test booking as part of the 5DAY® course.
No cash alternative or refund is available if:
- You book your own practical test;
- You supply your own vehicle for the practical test;
- You choose not to use a 5DAY® vehicle;
- You are not approved to use a 5DAY® vehicle for safety reasons;
- You book a practical test at a location, date or time that 5DAY® cannot reasonably support.
7.2 Vehicle Use for Practical Test
A 5DAY® training vehicle may be provided free of charge for your first practical driving test, subject to all of the following:
- You have passed your theory test;
- You have completed the original 5DAY® course;
- Your instructor confirms you are test-ready and safe;
- The practical test centre is local to the 5DAY® training area;
- The test date, time and location are suitable for instructor and vehicle availability;
- The pupil has checked suitable practical test centre locations with the 5DAY® test team before booking;
- 5DAY® has confirmed vehicle availability in writing.
Vehicle use cannot be guaranteed for tests booked outside the local 5DAY® training area or without prior written confirmation from 5DAY®.
No cash alternative or refund will be provided where the pupil chooses not to use, cannot use, or is not approved to use a 5DAY® vehicle for the practical test, except where required by law.
If your practical test is cancelled or changed by the DVSA without sufficient notice under DVSA rules, 5DAY® will make reasonable efforts to rearrange vehicle use where practical. However, complimentary vehicle use may be deemed used or forfeited where instructor time or vehicle availability has already been committed and cannot reasonably be rearranged.
5DAY® reserves the right to withhold the vehicle if the instructor reasonably believes the pupil poses a risk to safety, is not test-ready, or is not capable of safely controlling the vehicle during the practical test.
For safety reasons, the instructor’s decision on whether a 5DAY® vehicle may be used for a practical test is final. This does not prevent the pupil from taking the test in their own suitable vehicle or raising a complaint with 5DAY®.
Pupils who independently book their driving test should note that instructor and vehicle availability cannot be guaranteed. 5DAY® will make reasonable efforts to accommodate such bookings where possible; however, pupils remain free to use their own suitable vehicle for the test if preferred.
8. Mentoring & Retest Programme
If you fail your first practical test, you may qualify for the complimentary mentoring programme by submitting your DL25 test report to 5DAY® within 7 days of the test date.
Late submissions are ineligible unless 5DAY® agrees otherwise in writing.
Retraining focuses on addressing serious or dangerous faults identified on the DL25 test report. Retraining consists of one-hour remedial lesson sessions unless otherwise agreed by 5DAY®.
The mentoring programme concludes once your instructor confirms that the relevant remedial training has been completed or that you are test-ready.
Eligibility requires full completion of the original 5DAY® course.
Retest Fees
The following fees may apply to any further practical test support:
- Admin Fee: £25
- Car Hire: £180
- DVSA Test Fee: £62
Any DVSA fees paid through 5DAY® are passed in full to the DVSA. 5DAY® does not retain or profit from DVSA test fees.
9. Promotions and Offers
Promotional offers may be issued periodically. Each promotion will have specific terms at:
No adjustments, refunds or retrospective discounts apply to previously purchased courses unless expressly stated in the promotion terms.
10. Data Protection and Privacy
10.1 GDPR Compliance
5DAY® complies with the UK General Data Protection Regulation and the Data Protection Act 2018.
Your data will only be used where necessary and lawful, including to:
- Deliver your course;
- Book your DVSA theory test where applicable;
- Provide test-related guidance and administration where lawful;
- Liaise with instructors;
- Liaise with the DVSA where necessary and lawful;
- Process payments, refunds, finance or payment-provider enquiries;
- Investigate complaints, safeguarding concerns, insurance issues or legal disputes.
10.2 Instructor Contact
Your name, driver number, email address and mobile number may be shared with your assigned instructor solely for course coordination, training delivery, licence checks, safety, test-readiness assessment, and related administration.
Instructors are required to handle your personal data securely and to delete or return it when it is no longer required for the lawful purpose for which it was provided.
10.3 Audio and Video Recording
For safety, safeguarding, training-quality review, insurance purposes and the fair investigation of incidents or complaints, lessons may be recorded by audio and/or video.
Any recordings will be handled in accordance with 5DAY®’s privacy policy and retained only for as long as reasonably necessary for those purposes.
Recordings will not be used for marketing or public promotional purposes without separate consent.
11. Complaints Procedure
11.1 Reporting a Complaint
Complaints or concerns should be raised in writing during the scheduled course week wherever reasonably possible, so that 5DAY® has a fair opportunity to investigate and resolve any issue while the course is ongoing.
Before taking any further action, you must give 5DAY® a reasonable opportunity to address the matter directly with your assigned instructor.
Complaints raised after course completion will still be considered in good faith; however, delay may limit the evidence available and the remedies reasonably available.
This clause does not affect your statutory rights.

11.2 Evidence-Based Complaint Assessment
5DAY® is committed to fairness and transparency. Complaints will be assessed based on the evidence available, including course records, pupil communications, instructor comments, written documentation, recordings, witness statements and any other relevant information.
Where available, allegations, claims or disputes should be supported by independent, objective evidence, meaning verifiable evidence from a source other than the complainant or accused party.
Where only the pupil and instructor were present and no independent evidence exists, 5DAY® will consider the complaint in good faith based on the information available. However, 5DAY® is not required to accept an uncorroborated allegation as proven.
Failure to uphold or act upon an uncorroborated allegation shall not be treated as an admission of liability or wrongdoing.
Safeguarding, criminal, DVSA, insurance-related or serious safety concerns will be considered appropriately regardless of whether independent evidence is available.
Nothing in this clause limits or excludes liability for death, personal injury, fraud, or any statutory consumer rights under UK law.
11.3 Third-Party Inquiries
5DAY® cannot discuss your course, booking, payment, complaint or personal information with any third party, including parents, guardians, spouses, relatives or representatives, without written consent, in line with UK GDPR.
Where the pupil is an adult, consent must come from the pupil unless another lawful basis applies.
12. Force Majeure and Events Outside 5DAY®’s Control
5DAY® is not liable for delays, disruption or cancellations caused by events outside its reasonable control, including but not limited to:
- DVSA test centre closures;
- DVSA test delays, unavailability or cancellation;
- Instructor illness;
- Vehicle mechanical issues;
- Severe weather;
- Road closures, accidents or traffic disruption;
- Public emergencies;
- System failures outside 5DAY®’s reasonable control.
Where services are affected by an event outside 5DAY®’s reasonable control, 5DAY® will make reasonable efforts to provide an alternative arrangement where practical.
Refund Limitation
Refund requests will be assessed in accordance with these Terms & Conditions and the Customer’s statutory rights.
5DAY® may request clear and objective evidence that goods or services failed to meet the agreed specification, were not provided with reasonable care and skill, or were not of satisfactory quality under applicable consumer law.
Unsupported or unsubstantiated claims do not automatically give rise to a right to refund.
Any discretionary refund or goodwill gesture is offered at the sole discretion of management and does not constitute an admission of liability.
13. Legal Information
These Terms & Conditions do not affect your statutory consumer rights.
Nothing in these Terms & Conditions excludes or limits liability for death or personal injury caused by negligence, fraud, fraudulent misrepresentation, or any liability that cannot legally be excluded.
Calls may be recorded for training, quality, complaint handling, safeguarding, insurance and legal purposes.
14. Updates and Changes to Terms
5DAY® may update or amend these Terms & Conditions from time to time to reflect changes in law, regulatory requirements, DVSA rules, payment processes, operational requirements or business practices.
Any revised version will be published at:
The revised version will take effect immediately upon publication, unless a later date is specified.
The version of the Terms & Conditions in force at the time of your booking confirmation will apply to your course.
It is your responsibility to review the most recent version prior to booking and to retain a copy of the version applicable to your purchase.
Where a material change affects existing customers, reasonable steps will be taken to notify affected individuals by email or other appropriate means.
Nothing in this clause permits 5DAY® to retrospectively remove or reduce a Customer’s statutory rights.
15. Entire Agreement
These Terms & Conditions constitute the entire agreement between you and 5DAY® and supersede all prior discussions, communications or representations, whether oral or written, except for any statutory rights or legally binding pre-contract information that cannot lawfully be excluded.
No variation shall be valid unless made in writing and approved by an authorised representative of 5DAY®.
Nothing in these Terms & Conditions affects any rights that cannot legally be excluded or limited.
